1. Introduction

Welcome to stillwaterphotocharter.com. By accessing this website and booking a charter, you agree to comply with and be bound by the following terms and conditions. These terms govern the relationship between Stillwater Photo Charter ("we," "us," or "the Company") and the client ("you" or "the Guest").

2. Booking and Payments

  • Reservation: A booking is only confirmed once a deposit or full payment has been received.

  • Pricing: All prices are subject to change; however, once a booking is confirmed, the price for that specific charter is locked in.

  • Payment Methods: We accept major credit cards and digital payments as specified on our checkout page.

3. Cancellations and Weather Policy

  • Guest Cancellations: Refunds are issued based on the timeline specified in our FAQ (e.g., full refund for 7+ days' notice).

  • Weather Decisions: The Captain has the sole authority to cancel or cut short a trip due to safety concerns (high winds, lightning, or small craft advisories). In such cases, a full refund or reschedule will be provided.

  • No-Shows: Failure to arrive at the designated meeting point at the scheduled time will result in a forfeiture of the full charter fee.

4. Safety and Conduct

  • Captain’s Authority: For the safety of the vessel and all passengers, the Captain’s instructions must be followed at all times. Failure to comply may result in the immediate termination of the charter without a refund.

  • Illegal Substances: The use of illegal drugs or the excessive consumption of alcohol is strictly prohibited on board.

  • Health Disclosure: Guests are responsible for notifying the Company of any physical limitations or medical conditions that may affect their safety during the trip.

5. Equipment and Liability

  • Guest Gear: Stillwater Photo Charter is not responsible for the loss, theft, or damage of personal photography equipment, electronics, or clothing brought on board. We recommend all guests carry appropriate insurance for their gear.

  • Company Property: Guests may be held liable for damage to the vessel or Company-provided equipment caused by negligence or intentional misuse.

6. Wildlife and Environment

  • No Guarantees: While we utilize our local expertise to locate wildlife, sightings are not guaranteed. Nature is unpredictable, and no refunds will be issued based on the lack of specific wildlife sightings.

  • Ethical Viewing: We adhere to a "Leave No Trace" policy and strict wildlife viewing distances. Guests agree not to engage in any behavior that harasses or disturbs the local ecosystem.

7. Media and Copyright

  • Guest Content: You retain all copyrights to the images and videos you capture during the charter.

  • Marketing Release: By participating, you grant Stillwater Photo Charter permission to take photos or videos of the tour for promotional use (social media, website, etc.), unless you explicitly opt out in writing prior to departure.

8. Limitation of Liability

Participation in a maritime charter involves inherent risks. By booking, you acknowledge these risks and agree to release Stillwater Photo Charter and its employees from liability for personal injury, illness, or property damage, except in cases of gross negligence.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Maryland. Any disputes arising from these terms shall be resolved in the courts of the relevant jurisdiction.
